When prices increase it's the subbies that pay the extra over

Material price increases are routine in the construction industry, but they’re usually applied predictably in March and October of each year, for a similar % each time.

But when economic instability like a pandamic, or a traffic jam on the Straight of Hormuz pops up, the increase notification letters hit double digits every thirty days.

Now, builders will say this affects them too - but I call bluff on that, because most subcontractors are signed up under “Fixed Price” or “Lump Sum” contracts, that are not subject to rise and fall.

This is made worse by the fact that once a builder’s contract is signed, subcontractor’s have no termination rights, unless the builder is in substantial breach (which very rarely occurs).

So, what can you do to protect yourself?

Meet Michelle

Michelle Cirson is the Principal Lawyer and founder of Subcontractor Legal and creator of the Subbies' Toolbox.

A construction lawyer, adjudicator, and former builder’s contracts administrator with formal qualifications in both building and law.

Michelle has drafted and managed contracts from every tier on the contract chain - and now she teaches subbies how to manage their builders' contracts, and get paid on time.

If anyone knows how to win the builder game - it’s Michelle.

What my clients are saying...

"Michelle and she sets us on the right path. That peace of mind is priceless"

"Whenever we do anything new in our business or even if I just have a gut feeling something is a bit risky I run it by Michelle and she sets us on the right path. That peace of mind is priceless.

If you have any doubt whatsoever about whether or not you need this service contact me via our website and I'll tell you all the reasons you do."

Brice Gifkins - BMG Building

"The advice Michelle gave us helped us avoid a huge issue that I would never have seen coming..."

"Michelle found us a few years ago when she contacted us out of the blue because she noticed something on our website that she knew could become a huge problem for us in the future.

This isn't the first time I've been in business and we run a tight ship so I didn't think there would be much that she could tell me that I didn't already know, but I’m always looking to improve so I agreed to a meet and greet.

I'm glad I did because Michelle was right about what she found and the advice she gave us helped us avoid a huge issue that I wouldn't have seen coming.

From that point on I've had Michelle review all of our builder's contracts before we sign them, and I always will. I've even had Michelle phone builders to help negotiate contracts for me and we haven't missed out on a single job because we read the fine print and ask for changes."

Jon Agostinelli - Fast-Tracked Constructions

"Michelle helped me raise our contractual issue properly in a gentleman’s way, without inflaming the problem..."

"We never usually have issues with builders but recently a job looked like it was going to go south due to a discrepancy in the head contract.
I wasn’t keen on conflict but I knew we couldn’t let it get out of hand.
Michelle helped me raise the issue properly under the contract in a gentleman’s way and when the time came she helped me get my spiel in order for a meeting with the builder.
It was great having help from someone who understands technical aspects of plans and construction and can talk the lingo with builders but also keeps you on track with the contract too.
It’s not something I would have done on my own but it was highly effective.”
